1. Qualification of the service
Shakadabra S.r.l. (Via Velasquez 19, 90141 Palermo, Italy, Tax Code and VAT 07262490829) operates the Shakadabra platform, which allows Providers to publish Experiences and Explorers to upload Video Reviews disseminated to the public in the feed. Shakadabra therefore operates as a hosting service provider and online platform within the meaning of Art. 3 of Regulation (EU) 2022/2065 (the "DSA"), allowing consumers to conclude distance contracts with traders.
Shakadabra qualifies as a micro or small enterprise under Recommendation 2003/361/EC. Pursuant to Articles 19 and 29 DSA, the additional obligations of Sections 3 and 4 of Chapter III therefore do not apply, and pursuant to Art. 15(2) the transparency reporting obligations do not apply. The obligations of Sections 1 and 2 of Chapter III (Articles 11-18) remain applicable and are described on this page. Shakadabra also voluntarily adopts certain additional user-protection measures.
2. Points of contact (Articles 11 and 12 DSA)
- For Member State authorities, the European Commission and the European Board for Digital Services: e-mail [email protected], PEC [email protected].
- For recipients of the service: e-mail [email protected] and the in-app "Report" feature.
Communications may be made in Italian and English.
3. Reporting illegal content (Article 16 DSA)
Any individual or entity may notify Shakadabra of content on the Platform they consider illegal (for example: content infringing copyright or trademarks, defamatory content, offers of services in breach of consumer-protection law). Notices may be submitted via the "Report" button on videos and experiences or by e-mail to [email protected] and must include: (a) a sufficiently substantiated explanation of why the content is considered illegal; (b) the exact location of the content (URL or identifier); (c) the notifier's name and e-mail, except for content related to offences under Articles 3 to 7 of Directive 2011/93/EU; (d) a good-faith statement as to the accuracy and completeness of the notice.
Shakadabra confirms receipt, reviews the notice and decides in a timely, diligent, non-arbitrary and objective manner, informing the notifier of the decision. Where automated tools are used, this is stated in the communication.
4. Statement of reasons (Article 17 DSA)
Where Shakadabra removes content, restricts its visibility, suspends or terminates monetisation (including Earn from Review commissions), or suspends or terminates an account, it provides the affected recipient with a clear and specific statement of reasons, indicating: the facts and circumstances, the legal ground or contractual clause relied upon, whether automated means were used, and the redress options available.
5. Content moderation (Article 14 DSA)
Rules on permitted content are set out in the Video Reviews and community guidelines section of the Terms and Conditions. Moderation combines automated analysis of images, video and text (filters and classifiers, including AI-based) and human review. Complaints against moderation decisions may be submitted to [email protected] and are reviewed with human oversight. Users may also refer disputes to a certified out-of-court dispute settlement body under Article 21 DSA, where established, and in any case to the courts.
6. Notification of suspected criminal offences (Article 18 DSA)
Where Shakadabra becomes aware of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of persons, it promptly informs the competent authorities.
